A Kogi State High Court Five sitting in Lokoja has sustain it’s interlocutory injunction restraining the All Progressives Congress, APC, gubernatorial aspirant, Muritala Yakubu Ajaka from participating in the party’s congress slated for tomorrow

Presiding Judge, Justice Abubakar Ibrahim said the second defendant, Murtala Yakubu Ajaka has not challenged his suspension nor appealed the laid down procedure of the party.

Justice Ibrahim said all the argument canvassed by lead Counsel to the second defendant cannot sway the course of justice in view of the non challenging of his suspension by the Ajaka ward of the APC.

Speaking after the ruling, lead Counsel to the second defendant, John Adele, SAN, said he has been directed by his client to appeal the ruling immediately in view of the forthcoming Congress slated for tomorrow

According to him, the second defendant had earlier in the week secured an injunction from a High Court in the Federal Capital Territory, FCT, to the effect of allowing his client to participate in the APC Congress.

He disclosed that a motion of stay of execution is already being filed against the ruling.

Also speaking, Barr. Victor Apaila said all legal means would be pursued to get the interlocutory injunction of the Kogi State High Court set aside by a Court of competent jurisdiction.

Counsel to the second Claimant Applicant, Peter Femi Joseph declined comment on the ruling.

Meanwhile, Justice Abubakar Ibrahim has fixed the fourth of May for the hearing of the substantive suit in the matter.
